Preliminary Applications


This Practice Direction will come into effect on the date of signature. It may be cited as Practice Direction 3 of 2009 – Preliminary Applications and may be abbreviated to PD 3/2009.

Preliminary Applications

1. This Practice Direction should be read in conjunction with the Rules of the DIFC Courts and in particular Rule 7.1 (How to Start Proceedings) and Part 23 (General Rules about Applications for Court Orders)


2. For the sake of clarification, Application Notices will not be accepted by the Registry unless they relate to a proceeding which has already been commenced using a claim form.


3. This approach ensures that there is a definitive document marking the commencement of a proceeding, as well as the application of the procedures for filing and service of a claim form.
