UPON reading the Application Notice dated 3 February 2013 (No. CFI 012/2012/3 filed on behalf of the Defendant/Applicant

AND UPON reading the material as filed save for documents submitted for confidential review and upon redacting from the public Court record all references to the identity and personal data of third parties

AND UPON hearing counsel for the Defendant/Applicant and counsel for the Claimant/Respondent at the hearing on 18 March 2013

IT IS HEREBY ORDERED THAT:

1. The Claimant and his legal representatives KBH Kaanun deliver up and return to Dubai Aerospace Enterprise (DAE) Ltd all of its property including but not limited to documents in their possession, custody or control in whatever form (electronic or otherwise).

 

2. The Claimant shall provide a Disclosure Statement dealing with the following topics:
a. At what stage did he take copies from the Defendant’s files;
b. What copies did he take;
c. In what form were they removed;
d. Identifying the purpose for which they were removed;
e. Identifying the extent of the efforts that have been made to locate and return the documents;
f. Specifying the documents he no longer conrols and what has become of them.

 

3. That the Claimant be restrained (whether by himself or by instructing or encouraging or permitting any other person) from further processing or disclosing the documents which he is required to disclose and/or deliver up without further order of the Court.

 

4. The Defendant/Applicant’s costs of and incidental to this Application are in the case, to be the subject of detailed assessment if not agreed.

 

5. Liberty to apply.
