UPON reviewing the Application Notice CFI-045-2012/2 filed on 5 January 2014;

AND UPON reading the parties’ submissions;

AND UPON hearing Counsel for the Claimant and Counsel for the Defendant on Thursday 6 February 2014;

IT IS HEREBY ORDERED THAT:

1. The Claimant’s Application is granted.

 

2. The Defendant shall file and serve, by no later than 4pm on Thursday 16 February 2014, a letter addressed to the Claimant:

 

(a) Setting out the steps he has taken to comply with the Defendant’s disclosure obligations and the Claimant’s Request to Produce Schedule.

 

(b) Identifying which documents listed in the Request to Produce Schedule do not exist.

 

(c) Identifying which documents listed in the Request to Produce Schedule are subject to privilege.

 

3. Each party shall bear their own costs of this application.

 

4. Liberty to apply.
