IT IS HEREBY ORDERED THAT:

1. The Appellants’ appeal be dismissed.
2. The Appellants pay the Respondent’s costs in relation to:

(i) the appeal;
(ii) Applications CFI-030-2011/3 dated 3 September 2012 and CFI-030-2011/5 dated 6 November 2012;
(iii) the preparation of submissions concerning permission to appeal ordered by the Court.

Such costs to be assessed if not agreed.
