UPON reviewing the Defendant’s Application Notice CFI-012-2014/2 dated 21 September 2014 to strike out part of the Claimant’s Claim and the evidence attached (“the Application”)

AND UPON reviewing the Claimant’s submissions in reply to the Application

AND UPON hearing Counsel for the Claimant and Counsel for the Defendant on 26 November 2014

PURSUANT TO Rule 36.40 of the Rules of the DIFC Courts, paragraph 2 of this judgment has been amended.

IT IS HEREBY ORDERED THAT: 

1. The Application is dismissed.

2. The Defendant shall pay the Claimant’s costs, 50% of which shall be paid by way of interim payment within 7 days pending assessment of the balance, unless otherwise agreed.
