UPON the Application made under RDC Part 8 by FCI Markets Inc. (in liquidation) (“FCI Markets”) dated 4 March 2019 for the recognition of (i) the liquidation of FCI Markets by an Order of the Eastern Caribbean Supreme Court in the High Court of Justice, Virgin Islands (the “BVI Court”) dated 15 January 2018 issued pursuant to Section 163 of the BVI Insolvency Act (the “BVI Liquidation Order”) appointing Paul Pretlove and Angela Barkhouse of Kalo (BVI) Limited (“Kalo”) as Joint Liquidators of FCI Markets (the “Order of Appointment”), and as amended or varied by (ii) the subsequent order by the BVI Court entered on 16 July 2018 and which second order continued the appointment Paul Pretlove in its sole capacity as Liquidator of FCI Markets following the removal with effect from that date of Angela Barkhouse as co-appointee (the “Sole Liquidator Amendment Order”).

AND UPON hearing Counsel for the Company, Mr. Tim Prudhoe, instructed by Carlo Fedrigoli (Onoma FZE) at the hearing before H.E. Justice Ali Al Madhani on 25 March 2019.

AND UPON reviewing the Witness Statement of Carlo Fedrigoli dated 1 March 2019 in support of the Application.

IT IS HEREBY ORDERED THAT:

  1. The BVI Liquidation Order and the Order of Appointment in respect of Paul Pretlove, as varied by the Sole Liquidator Amendment Order be and are hereby recognised.
  2. There be no order as to costs.
  3. Liberty to apply.
