ORDER MADE ON 14 JUNE 2009

UPON READING:

1. The Claimant’s Applications dated 30 April 2009 and 5 May 2009 for permission to appeal against the Order of Justice Tan Sri Siti Norma dated 16 February 2009 whereby the Default Judgment obtained by the Claimant against the Defendant dated 11 January 2009 was set aside;

 

2. The Judgment of Justice Tan Sri Siti Norma giving Reasons for the said Order, dated 12 March 2009; and

 

3. The 15th Statement of Anna Dadic dated 30 April 2009 and the documents annexed thereto.

IT IS HEREBY ORDERED:

1. That the Application for permission to appeal is REFUSED;

 

2. Pursuant to RDC 44.16, that the Applicant (Claimant) may not request that this decision be reconsidered at a hearing;

 

3. That NO ORDER is made on the Application for an extension of time; and

 

4. That the Applicant (Claimant) shall bear the costs of this Application, including the Defendant’s costs thereof, in any event.
