UPON reviewing the Defendant’s Application Notice CFI-013-2011/8 and supporting documents dated 17 September 2013

AND UPON reviewing the Claimant’s response via email dated 22 September 2013 and the Claimant’s Witness Statement of Shiraz Sethi in response dated 23 September 2013

IT IS HEREBY ORDERED THAT:

1. The Defendant’s Application for permission to submit the ‘Re-Re Amended Statement of Defence and Counterclaim’ filed with the Registry on 17 September 2013 is granted.
2. The Claimant, being the Respondent to the Counterclaim, is at liberty within 2 days of this Order to either submit a ‘Re-Amended Reply and Defence to Counterclaim’ or submit responses to the Defendant’s ‘Re-Re-Amended Statement of Defence and Counterclaim’ in the Claimant’s Skeleton Arguments, or both.
3. The Defendant is to pay the costs of this Application.
