UPON reviewing the Defendant’s Application dated 3 June 2018 (the “Application”) seeking to vary or set aside the Notice of Discontinuance order dated 27 February 2018

AND UPON reading the parties’ submissions

AND UPON reading the relevant material in the case file;

AND PURSUANT TO Rule 34.15 and Rule 38.41(3) of the Rules of the DIFC Courts

IT IS HEREBY ORDERED BY THAT:

1.The Defendant’s Application is granted.

2. The Notice of Discontinuance Order dated 27 February 2018 shall be varied.

3. The Claimant shall pay the Defendant’s costs of the action.

4. The Claimant shall pay the Defendant’s costs of the present application.

5. The costs ordered above be subject to detailed assessment if not agreed within 14 days of the date of this Order
