UPON reviewing the Claimant's Request to Produce dated 03 June 2013;

AND UPON reviewing the Defendant's Objections to the Claimant's Request to Produce dated 18 June 2013;

AND UPON reviewing the Defendant's Request to Produce dated 11 June 2013 and the Claimant's Response to the Defendant's Request dated 17 June 2013;

AND PURSUANT to Articles 28.13 to 28.22 of the Rules of the DIFC Courts;

IT IS HEREBY ORDERED THAT:

1. The Defendant shall produce to the Claimant within 14 days the Plot Documents delivered by the Master Developer to the Defendant;

 

2. The Courts reject the Claimant's requests 3, 5, 6, 13 & 15 (in the light of the responses submitted by the Defendant on 18 June 2013) and the Defendant's Requests for lack of sufficient description regarding their relevance and materiality.
