UPON the Claimants’ Part 7 Claim Form dated 14 January 2022 relating to various reinsurance contracts (the “Reinsurance Contracts”) (the “Claim”)
AND UPON the Case Management Order of H.E. Justice Nassir Al Nasser dated 8 March 2023 (the “CMO”)
AND UPON the Claimants’ Application No. CFI-003-2022/6 dated 29 March 2023 filed pursuant to paragraph 2(a) of the CMO seeking an order declaring that DIFC laws apply as the governing law of the Reinsurance Contracts (the “Application”)
AND UPON the parties agreeing to vary the deadlines contained in the CMO for filing the evidence in answer and the evidence in reply to the Application
AND UPON the Defendant’s evidence in answer to the Application dated 25 May 2023
AND UPON the Claimants’ evidence in reply to the Application dated 4 May 2023
AND UPON considering the Rules of the DIFC Court
IT IS HEREBY ORDERED THAT:
1. The governing law of the Reinsurance Contracts is the DIFC law.
2. The Defendant shall pay the Claimants' costs of the Application, to be assessed by the Registrar on the standard basis, if not otherwise agreed.
