UPON reading the Claimant's Application Notice CFI 012/2010/08 dated 11 April 2013

 

AND UPON reading the Second Defendant's Application Notice CFI 012/2010/09 dated 15 April 2013 requesting permission to add Mr Sami Caracand as a party to the proceedings for the purpose of Costs

 

AND UPON hearing counsel for the Claimant and counsel for the second Defendant at the Application hearing held on 17 April 2013

 

IT IS HEREBY ORDERED THAT:

 

1. The Court adjourns dealing with Application CFI 012/2010/08 and Application CFI 012/2010/09 to 6 May 2013.

 

2. The Second Defendant shall have permission under RDC 9.31 to serve the Application CFI 012/2010/9 on Mr Sami Caracand:

 

a. at the offices of Smartpaper Computer Software LLC, and

 

b. at Mr. Sami Caracand's email addresses,(scaracand@smartpaperbpm.com) (sami@cloudconceptgroup.com).

 

3. The Application CFI 012/2010/9 will be considered served on Mr Sami Caracand on the same business day as it is sent by email, if sent before 4pm that day, otherwise on the business day after the day on which it is sent.

 

4. Mr Sami Caracand shall file and serve his Response to Application CFI 012/2010/9 by 24 April 2013.

 

5. The Second Defendant shall file a Reply to Response to Application CFI 012/2010/9 by 1 May 2013.

 

6. Costs reserved until the hearing listed on 6 May 2013.
