AND UPON hearing counsel for the Defendant and the Claimant at the Application Hearing held on 17 January 2011 before Deputy Chief Justice Sir Anthony Colman

 

IT IS HEREBY ORDERED BY CONSENT THAT:

1. The Defendant is entitled to a declaration that the Court has no jurisdiction to try the claim.

 

2. The claim is struck out.

 

3. The Claimant shall pay the Defendant's cost of these proceedings, of Application No. 081/2010 and of the hearing on the standard basis to be assessed if not agreed.
