SCHEDULE OF REASONS
1. This is an application by the Claimant under Rule 36.41 of the Rules of the DIFC Courts (“RDC”) to correct what are said to be obvious errors in the figures contained within paragraph 1 of the Order with Reasons dated 27 July 2026 (the “Order”) permitting judgment to be entered for the Second Claimant against the First and Second Defendants (the “Application”).
2. Three relevant errors are sought to be corrected:
(a) First the EUR figure in paragraph 1(a) of the Order should be EUR 4,218,152.30 not EUR 4,218,152.130;
(b) Secondly the USD figure in paragraph 1(b) of the Order should be USD 3,885.78 not 3,855.78; and
(c) Thirdly paragraph 1(c) of the Order miscalculates interest for the stated period on each of the principal sums in that it purports to calculate it for the period from 10 March 2025 to 27 July 2026 (which is a 504 day period) but actually only does so for a 365 day period.
3. The Application is supported by a witness statement from Haya Al Bawab which explains the relevant corrections.
4. The Application is opposed by the Defendants. There are very minor points of calculation disputed. However the substantive points made go to the validity of the judgment. These are not relevant to an application for correction.
5. RDC 36.41 provides “The Court may at any time correct an accidental slip or omission in a judgment or order”.
6. I am satisfied that there were such accidental errors. The only one of any materiality was the mistake as to the period for which interest was to run which was wrongly calculated for only a year rather than 504 days. If it had not been for this slip, I very much doubt the Application was made.
7. As to the remaining corrections, they are trivial but in view of the Defendant’s assertions as to what are the correct calculations, the lower sums are used.
