UPON the Part 8 Claim Form dated 18 March 2025, as amended on 30 May 2025
AND UPON the Case Management Order of H.E. Roger Stewart dated 20 November 2025 (the “CMO”)
AND UPON the Consent Order dated 12 May 2026, varying the procedural timetable in the CMO (the “Consent Order”)
AND UPON the Claimant’s Application No. CFI-032-2025/5 dated 5 June 2026 for permission, pursuant to Rule 31.13 of the Rules of the DIFC Courts (“RDC”) to rely on expert evidence (the “Application”)
AND UPON considering the Fifth Witness Statement of Anthony Jason Wong dated 5 June 2026 and the documents exhibited thereto
IT IS HEREBY ORDERED THAT:
1. The Claimant is granted permission, pursuant to RDC 31.13 to rely on the following expert reports:
(a) The Consultative Accounting Report prepared by Maitha Salem Al Zaabi of Maitha Alzaabi Auditing dated 13 February 2025 together with its English translation; and
(b) The Forensic Accounting Report prepared by Dr Fatima Marzouk Al Ali of Accounts Icon Auditing dated 25 September 2025.
2. Any responsive experts from the Defendant shall be filed and served by no later than 4pm on 31 July 2026.
3. The experts shall meet and file a joint report no later than 4pm on 14 August 2026.
4. Costs shall be in the case.

SCHEDULE OF REASONS
1. In the Application, the Claimant seeks permission to rely on two identified expert reports.
2. Provision was made in the CMO for either party to seek to rely on expert evidence with a timetable provided for responsive evidence and joint reports.
3. That timetable was varied by the Consent Order.
4. The Application was made within the varied time.
5. The Defendant has not sought to oppose or otherwise identify its position in relation to the Application.
6. I have considered the Application and considered that the expert evidence should be admitted.
7. The other directions are those already ordered. If any issues arise in relation to this, I will deal with them at the Pre-Trial Review listed on 19 August 2026.
