ORDER WITH REASONS OF H.E. JUSTICE RENE LE MIERE
UPON the Claimant’s Part 7 Claim Form dated 3 April 2026
AND UPON the Claimant’s Application No. CFI-032-2026/2 dated 21 September 2026 seeking cancellation of the Claimant’s UAE visa and sponsorship (the “Application”)
AND UPON review of the Defendants’ evidence in answer to the Application dated 23 September 2026
AND UPON review of the Claimant’s evidence in reply to the Application dated 25 September 2026
IT IS HEREBY ORDERED THAT:
1. Within three business days of the date of this Order, the First Defendant shall provide to the Claimant’s legal representatives the actual document required by the DIFC Government Services Office to cancel the Claimant’s UAE residence visa and sponsorship through the cancellation-with-pending-dues procedure.
2. Subject to paragraphs 3 and 4 below, within five business days of receipt of that document, the Claimant shall:
(a) sign and return it to the First Defendant’s legal representatives;
(b) provide copies of his passport, current visa and Emirates ID; and
(c) cooperate in completing all further formalities reasonably required by the competent authorities for cancellation, including attending any required appointment.
3. Neither party shall require the other, as a condition of cancellation, to make any disputed payment or execute any waiver, release, no-dues confirmation, settlement agreement or substantive admission compromising any claim, defence, counterclaim, right or remedy in these proceedings. This paragraph does not excuse compliance with ordinary administrative formalities or acknowledgments which do not have that effect.
4. If the Claimant objects that any document required for cancellation is inconsistent with paragraph 3:
(a) his legal representatives shall identify the particular wording and grounds of objection in writing within two business days of receiving the document;
(b) the parties shall confer within the following two business days to seek to resolve the objection;
(c) if the objection remains unresolved, the Claimant shall apply for further directions within two business days after that conference, supplying the document and the relevant correspondence;
(d) pending determination of an application made within that period, the obligation to execute the disputed document shall be suspended, but all other obligations under this Order shall continue; and
(e) an objection shall not otherwise suspend compliance with this Order unless the Court directs.
5. Within five business days of receiving the signed cancellation document and the supporting documents required from the Claimant, the First Defendant shall lodge the cancellation request through the cancellation-with-pending-dues procedure and execute all documents required of it as sponsor. It shall thereafter take all further steps reasonably required of it to secure completion as soon as reasonably practicable.
6. Neither party shall withhold or delay cooperation in cancellation by reason only of the existence of the substantive proceedings or any disputed claim for payment.
7. Each party shall confirm in writing to the other’s legal representatives, within two business days of completing any step required by this Order, that the step has been completed. The First Defendant shall provide documentary confirmation of cancellation to the Claimant’s legal representatives within two business days of receiving it.
8. This Order, compliance with it and cancellation of the Claimant’s visa and sponsorship:
(a) are without prejudice to the parties’ respective claims, defences, counterclaims, rights and remedies in these proceedings; and
(b) shall not constitute or evidence any admission concerning the date, circumstances or lawfulness of termination, the authorisation or cost of the earlier visa renewal, responsibility for the delay in cancellation, or any disputed entitlement or liability.
9. Costs of the Application are reserved.
10. The parties have liberty to apply for further directions concerning implementation of this Order.

SCHEDULE OF REASONS
A. The Application
1. The Claimant applies for an order requiring the First Defendant to cooperate in cancelling his UAE residence visa and sponsorship. The First Defendant does not oppose cancellation through the cancellation-with-pending-dues procedure. The matters requiring determination are the terms of the order and costs.
2. The parties dispute responsibility for the delay in cancellation. The First Defendant attributes the delay to the Claimant’s failure to cooperate. The Claimant maintains that the necessary cancellation document was not provided to him and that his signature was not requested before the Application. It is unnecessary to resolve that dispute to grant the practical relief now sought. I make no finding of default by either party.
B. Disposition
3. A reciprocal order is appropriate. The First Defendant must provide the cancellation document within three business days. Subject to the safeguards in the Order, the Claimant must sign and return it and provide the required supporting documents within five business days of receipt. The Claimant must also cooperate in completing the formalities reasonably required by the competent authorities.
4. Within five business days of receiving the signed document and the required supporting documents, the First Defendant must lodge the cancellation request and execute the documents required of it as sponsor. It must then take all further steps reasonably required to secure completion as soon as practicable.
5. Neither party may make cancellation conditional upon a disputed payment or upon the execution of a waiver, release, no-dues confirmation, settlement agreement, or substantive admission compromising the pending proceedings. Neither may withhold or delay cooperation merely because those proceedings or a disputed payment claim remains outstanding. These protections do not excuse compliance with ordinary administrative formalities or acknowledgments that do not have that effect.
6. The Order provides a defined procedure for objecting to the cancellation document. The Claimant must identify the specific wording and grounds of objection within two business days of receipt. The parties must confer within the next two business days. If the objection remains unresolved, the Claimant must apply for directions within two business days of that conference and provide the document and relevant correspondence.
7. While an application made within that period is pending, only the obligation to execute the disputed document is suspended. All other obligations continue. An objection does not otherwise suspend compliance unless the Court directs. This procedure prevents substantive concessions while avoiding an indefinite unilateral suspension of cancellation.
8. Each party must confirm completion of the steps required by the Order within two business days. The First Defendant must provide documentary confirmation of cancellation within two business days of receipt.
9. The Order, compliance with it, and cancellation do not constitute any admission regarding the date, circumstances, or lawfulness of termination, the authorisation or cost of the earlier visa renewal, responsibility for the delay, or any disputed entitlement or liability. All substantive claims, defences, counterclaims, rights, and remedies are preserved.
10. In light of the disputed circumstances surrounding the delay and the necessity of the Application, I reserve costs. I make the accompanying Order, with liberty to apply in relation to its implementation.
C. Orders
11. The Court orders:
