SCHEDULE OF REASONS
1. Having considered all of the materials before me on the Extension Application, I am satisfied that the delays in filing the submissions in opposition have arisen from an unusual and unfortunate concatenation of events including an exceptional cause of war in the Middle East and its knock-on effects, and the unavailability of counsel. 2. In all of the circumstances, fairness and justice requires the granting of a final extension as sought.
3. The Court has noted the Defendant's reasonable complaints about delay in fixing hearing dates in relation to extant matters and considers it appropriate to inform the Claimant and its representatives that there are limits to delays that the Court will countenance due to unavailability of chosen counsel - even in serious and complex cases such as this.
4. They should take such steps as are necessary to ensure that timelines for procedural steps are not so prolonged or missed going forward in this litigation, due to the unavailability of counsel.
