UPON the Part 8 Claim dated 18 September 2025
AND UPON the Urgent Application No. CFI-082-2025/1 dated 18 September 2025, seeking injunctive relief (the “Application”)
AND UPON reading the witness statement of Tim Stokes dated 18 September 2025
AND UPON hearing counsel for the Claimant and counsel for the Defendants at the Urgent Application Hearing before H.E. Deputy Chief Justice Ali Al Madhani on 25 September 2025
AND UPON the Court accepting the undertakings provided by the Claimant set out in Schedule 1 to this Order
AND WITH reasons for this Order to be issued in due course
IT IS HEREBY ORDERED THAT:
1. Until 12 November 2025, the First Defendant shall not whether directly or indirectly (whether on its own account or through others, and whether by itself, its servants, agents, or otherwise howsoever), engage or knowingly permit the Second Defendant to carry out any work on behalf of itself or any member of the Ardonagh Group (whether as an employee or otherwise).
2. Until 12 November 2025, the Second Defendant shall:
(a) Undertake no work for or on behalf of the First Defendant or any member of the Ardonagh Group (whether as an employee or otherwise);
(b) Not endeavour to solicit or entice the business or custom of any Relevant Client or Relevant Prospective Client, or have any dealings or transacting business which is the same as or similar to Restricted Business with any Relevant Client or Relevant Prospective Client.
3. The Second Defendant shall within 48 working hours from the issue of this Order provide a signed statement pursuant to clause 23.1(c) of the Employment Agreement confirming his compliance with the obligations in Clause 23 of the Employment Agreement, specifically the obligations to
(a) immediately deliver to the Claimant all Company Property which is in the Second Defendant’s possession or under his control, and to sign a declaration as such, and
(b) having first forwarded a copy to the Claimant, irretrievably delete from any computer or information system which does not belong to him any information relating to the business of any Group Company which is in his possession or under his control.
Directions
4. The Claimant shall file a Part 7 Claim by 4pm within 7 days from the date of issue of this Order. The Claim shall hence proceed according to the rules and procedures of the RDC.
Costs
5. The Defendants shall pay the costs of this Urgent Application.
6. The Claimant shall submit within 3 days from the date of issue of this Order, submissions on its costs not exceeding 3 pages.
7. The Defendants shall submit, within 3 days of service of the Claimant’s submissions on costs, its reply.
Service of this Order
8. This Order shall be served by the Claimant on the Defendants.
