UPON the Judgment of H.E. Justice Shamlan Al Sawalehi dated 9 July 2026 (the "Judgment")
AND UPON the Claimant's costs submissions dated 10 July 2026
AND UPON the Claimant's Statement of Costs dated 13 July 2026
AND UPON considering Part 38 of the Rules of the DIFC Courts ("RDC") and Practice Direction No. 4 of 2017 Interest on Judgments
IT IS HEREBY ORDERED THAT:
1. The Defendant shall pay the Claimant 50% of the Claimant's costs assessed on the standard basis, in the total sum of AED 645,515.82 (the "Costs Award").
2. The Defendant shall pay the Costs Award to the Claimant within 14 days of the date of this Order, pursuant to RDC 38.40.
3. In the event that the Defendant fails to pay the Costs Award within 14 days of the date of this Order, interest shall accrue at the rate of 9% per annum from the date of this Order until payment in full, in accordance with Practice Direction No. 4 of 2017.

SCHEDULE OF REASONS
1. This Order concerns the assessment of the Claimant's costs of the Claim and the Counterclaim, following the Judgment.
2. Pursuant to paragraph 73 of the Judgment, applying the ordinary principle that costs follow the event, the Defendant was ordered to pay the Claimant's costs of the Claim and the Counterclaim, including the reserved costs of the Order of H.E. Justice Nassir Al Nasser dated 19 June 2025 and of the Jurisdictional Challenge Order.
3. Pursuant to paragraph 74, the Claimant was directed to file a Statement of Costs not exceeding four pages within five days of the Judgment.
4. The Claimant filed its costs submissions and its Statement of Costs dated 13 July 2026, claiming professional fees of AED 1,175,430 together with disbursements of AED 115,601.63, a combined total of AED 1,291,031.63. The reserved costs referred to above are subsumed within those totals and have not been itemised separately.
5. The Claimant's costs submissions invite the Court to assess costs on the indemnity basis, relying on the Defendant's conduct in advancing and later withdrawing an unsubstantiated forgery allegation, and in adopting shifting and ultimately unsuccessful positions in his Defence and Counterclaim.
6. I do not accept that invitation. Indemnity costs are reserved for conduct taking a case out of the norm of contested commercial litigation. The Defendant's conduct, including the abandoned forgery allegation and his failure to attend the Trial, is already reflected in the fact that he bears the whole of the Claimant's costs of these proceedings; it does not, in my judgment, meet the elevated threshold required to depart from the standard basis. The Claimant's costs are accordingly assessed on the standard basis.
7. In assessing those costs, the Court has had regard to Rule 38.7, 38.8 and 38.23 of the Rules of the DIFC Courts (“RDC”), and to the requirement that costs allowed on the standard basis be both reasonable and proportionate.
8. Having regard to the extended procedural history recorded in the Judgment, the overall volume and seniority of the fee earners engaged, and the need to ensure that the costs recovered are proportionate to the nature and value of the Claim, I consider it appropriate to allow recovery of 50% of the Claimant's costs as claimed.
9. The Defendant shall therefore pay the Claimant the sum of AED 645,515.82 as set out in the Order above.
