AND UPON the Amended Case Management Order of H.E. Justice Sir Jeremy Cooke dated 10 February 2026 (the “CMO”)
AND UPON the in-person Trial listed before H.E. Justice Sir Jeremy Cooke from 6 to 8 July 2026 (the “Trial”)
AND UPON the Claimant’s Letter Application dated 31 March 2026, filed pursuant to Rule 23.77 of the Rules of the DIFC Courts (the “RDC”) and subsequently paid for on 2 April 2026, seeking to vary the CMO to direct that the Trial be conducted remotely rather than in person (the “Letter Application”)
AND UPON the Defendant’s evidence in reply to the Defendant's Letter Application dated 1 April 2026
IT IS HEREBY ORDERED THAT:
1. The Letter Application is refused.
2. There shall be no order as to costs.

SCHEDULE OF REASONS
1. The credibility of the key witnesses is likely to be central to the determination of the issues between the parties, and the Trial is scheduled to take place in three months’ time.
2. The situation in the Middle East at the time of the Trial is not presently known or capable of prediction.
3. In the event that, closer to the Trial date, there are good safety or security reasons why the Trial cannot take place in person, an appropriate application may be made at that time
