PRACTICE DIRECTION NO.3 OF 2013
Schedule A to Part 26 of Rules of DIFC Courts – Case Management Information Sheet -Addendum
Citation
This Practice Direction will come into effect on the date of signature. It may be cited as Practice Direction 3 of 2013 – Case Management Information Sheet – Addendum – and may be abbreviated to PD 3/2013.
To Schedule A to Part 26 of the Rules of the DIFC Courts – Case Management Information Sheet (CMIS) – shall be added the following questions:
“Rights of Audience
(21) Do any of the parties’ legal representatives intend to request the
Court to waive or vary any limitation on their right to appear before the Court? If so, please identify the limitation and the reasons relied upon.
(23) Does the legal representative practice with a legal
practitioner already holding full rights of audience before the Court? If so, please identify the
Practitioner. Has the Practitioner agreed to provide appropriate guidance to the legal representative if such guidance is requested?
(24) Does the legal representative agree that in the event of their request being granted, they will be bound by, and conduct themselves during the proceedings in full accordance with, the requirements of the Code of Conduct for Legal
Practitioners in the DIFC Courts?”
A copy of the CMIS as it now reads is provided at attached Schedule 1.
The Court will decide on a case by case basis whether the granting of a waiver or variation is in the circumstances appropriate.
